Sunday, December 13, 2009 12:22 AM CST KINGMAN - A Bullhead City man arrested for an alleged drive-by shooting at a Bullhead City home in March was acquitted of all charges Friday.
Joseph Ken Cotten, 29, had been charged with four counts of endangerment, three counts of aggravated assault, two counts of drive-by shooting and one count each of discharging a weapon at a residence, criminal damage, disorderly conduct with a weapon and unlawful discharging of a firearm for an alleged drive-by shooting at a Colorado Boulevard home March 22. Both homes were occupied at the time but no one was injured. In his fourth trial, a Mohave County jury found Cotten not guilty of all the charges. One of aggravated assault charges was dropped during the week-long trial before Superior Court Judge Steven Conn.
Cotten's attorney, Shawn Hamp, said the ballastic and forensic evidence was not there and there was no eyewitnesses to tie Cotten to the crime. The jury deliberated for only about 30 minutes before reaching the verdict. In his third trial held in November, Cotten was found not guilty for a stun gun attack in June. He was acquitted of aggravated assault and criminal trespassing after he was arrested for the break-in and stun gun assault at a Hermosa Drive home June 15.

Sex Offense Defendant Freed Following Trial Acquittal KINGMAN - A Golden Valley man accused of sex offenses involving a nine year-old girl spent a year in jail awaiting trial. And John M., 45, was released shortly after a Mohave County Superior Court jury returned not guilty verdicts at the end of his trial Friday. Some of the jurors smiled at M. and wished him good luck as they exited the courtroom. ``I'm just relieved," said defense attorney Shawn Hamp. ``It's really hard when you know you believe in your client and their fate rests in 12 people. I just believe they did the right thing." Absolute acquittals are relatively rare at the Mohave County Courthouse and Hamp said he appreciated the jury's diligence and wisdom. He said the case hammers home the point that defendants are innocent until proven guilty, despite the prejudice that frequently accompanies sex offense charges. ``Sometimes we want to rush to help the victims and sometimes we let our sympathies and our emotions take over our logic," Hamp said. ``The evidence in this case just wasn't there."
